By accessing or using Basestream ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Basestream is a work intelligence platform that helps engineering teams track, measure, and understand their development activity. The Service integrates with third-party tools to automatically capture work entries and provide analytics, reports, and ROI insights.

3. Accounts and Organizations

To use the Service, you must create an account and may create or join an organization. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

Organization administrators are responsible for managing membership, roles, and integration settings for their organization.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code
• Resell, sublicense, or redistribute the Service without our written consent
• Submit false, misleading, or fabricated work activity data

5. Integrations and Third-Party Services

The Service allows you to connect third-party services (such as GitHub, Google Calendar, Fireflies, and others). By connecting an integration, you authorize us to access and retrieve data from those services as necessary to provide the Service.

You are responsible for ensuring you have the right to share data from third-party services with Basestream. We are not responsible for the availability, accuracy, or policies of third-party services.

6. Data Ownership

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited, non-exclusive license to use, process, and display your data solely to provide and improve the Service.

We do not claim ownership of your work activity data, integration data, or any content you submit.

7. Plans and Payment

The Service offers free and paid plans. Paid plans are billed on a per-user, per-month basis unless otherwise specified. You agree to pay all applicable fees for your selected plan.

We may change pricing with 30 days' notice. You may cancel your subscription at any time, with access continuing through the end of your current billing period.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned downtime.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, including for violation of these Terms. You may delete your account at any time.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASESTREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
